Algemene voorwaarden

Laatst bijgewerkt: 7 mei 2026 · Van toepassing op alle opdrachten en diensten geleverd door Kelly Kap (h.o.d.n. GrowthMaster).

1. Definities

• GrowthMaster: Kelly Kap, freelance webdeveloper, SEO-specialist en AI-automation expert. E-mail: kelly@growthmaster.nl. Telefoon: +31 6 57144073.
• Opdrachtgever: de natuurlijke of rechtspersoon die GrowthMaster opdracht geeft tot het leveren van diensten.
• Diensten: webdesign, SEO-audits, content-strategie, AI-automatisering, of andere afgesproken werkzaamheden.
• Overeenkomst: de schriftelijke afspraak (per e-mail volstaat) tussen GrowthMaster en de opdrachtgever waarin de scope, prijs en levertermijn staan.

2. Toepasselijkheid

Deze voorwaarden gelden voor alle offertes, opdrachten en overeenkomsten met GrowthMaster, tenzij schriftelijk anders overeengekomen. Eventuele inkoop- of andere voorwaarden van de opdrachtgever zijn uitdrukkelijk niet van toepassing.

3. Offertes en aanbod

• Alle offertes zijn vrijblijvend en hebben een geldigheidsduur van 14 dagen, tenzij anders aangegeven.
• Prijzen zijn exclusief BTW en exclusief eventuele kosten van derden (hosting, domeinnaam, third-party API's), tenzij expliciet anders vermeld.
• Een opdracht komt tot stand zodra de opdrachtgever het aanbod schriftelijk (per e-mail) heeft bevestigd.

4. Productized offerings

GrowthMaster levert daarnaast vaste pakketten met heldere scope en prijs:

• Site in 1 week — €749 setup + €395/mnd, minimum 6 maanden commitment. Inclusief Webflow- of Astro-site, basis-SEO, hosting, copywriting en 1 ronde feedback. Live binnen 14 dagen of geld terug.
• Daily Scan — €39/mnd. Dagelijkse SEO-audit met top-3 issues per mail. Maandelijks opzegbaar.
• Audit Plus — eenmalig €495. Diepgaande technische SEO-audit met implementatie-roadmap.
• Sprint — eenmalig €1.495. Eén-week-sprint voor specifieke groei-vraagstukken.
• Flows op autopilot — vanaf €495 setup + €99/mnd. AI-flows voor lead-handling, e-mail-automation of content-generatie.

5. Betaling

• Setup-bedragen worden vooraf gefactureerd en zijn binnen 14 dagen betaalbaar.
• Maandelijkse retainers worden aan het begin van elke maand gefactureerd via Stripe / handmatige factuur.
• Bij overschrijding van de betaaltermijn is GrowthMaster gerechtigd de werkzaamheden op te schorten en wettelijke rente in rekening te brengen.
• Voor maandcontracten geldt een opzegtermijn van 1 volledige kalendermaand na de minimum-commitmentperiode.

6. Levering en uitvoering

• GrowthMaster zal zich inspannen om afgesproken levertermijnen te halen, maar deze zijn indicatief tenzij uitdrukkelijk schriftelijk gegarandeerd (bv. de "live in 14 dagen of geld terug"-garantie).
• Wijzigingen in de scope na opdrachtverstrekking kunnen tot meerwerk leiden, dat in overleg apart wordt gefactureerd.
• De opdrachtgever zorgt tijdig voor benodigde input (content, toegang tot CMS/hosting, akkoord op concepten). Vertraging vanuit de opdrachtgever leidt niet tot wijziging in de overeengekomen prijs.

7. Garantie "live in 14 dagen of geld terug"

Voor het pakket Site in 1 week geldt: als GrowthMaster niet binnen 14 kalenderdagen na ontvangst van alle benodigde input een live website oplevert die voldoet aan de afgesproken scope, krijgt de opdrachtgever het volledige setup-bedrag terug. Dit geldt niet wanneer de vertraging veroorzaakt is door uitblijven van content/feedback van de opdrachtgever, of door overmacht (zie art. 11).

8. Intellectueel eigendom

• Tot volledige betaling van de factuur blijven alle rechten op het opgeleverde werk (code, design, content) bij GrowthMaster.
• Na betaling gaan de gebruiksrechten over op de opdrachtgever, met uitzondering van eventuele third-party componenten (bv. open-source libraries, stockfoto's, fonts) die hun eigen licenties houden.
• GrowthMaster behoudt het recht het opgeleverde werk te tonen in portfolio en case-studies, tenzij uitdrukkelijk anders overeengekomen.

9. Aansprakelijkheid

• De aansprakelijkheid van GrowthMaster is beperkt tot het bedrag dat in het betreffende geval door de aansprakelijkheidsverzekering wordt uitgekeerd, of bij gebreke daaraan tot maximaal het factuurbedrag van de betreffende opdracht.
• GrowthMaster is niet aansprakelijk voor indirecte schade, gevolgschade, gederfde winst, gemiste besparingen of schade door bedrijfsstagnatie.
• De opdrachtgever vrijwaart GrowthMaster tegen claims van derden ten aanzien van content/materialen die door de opdrachtgever zijn aangeleverd (bv. inbreuk op auteursrecht door aangeleverde foto's of teksten).

10. Vertrouwelijkheid

Beide partijen behandelen alle informatie die in het kader van de samenwerking wordt uitgewisseld als vertrouwelijk, voor zover de aard ervan dat redelijkerwijs vereist. Persoonsgegevens worden verwerkt conform de privacyverklaring.

11. Overmacht

Bij overmacht (zoals langdurige stroomuitval, ernstige ziekte, oorlog, pandemieën of grootschalige uitval van internet-infrastructuur) is GrowthMaster niet gehouden aan levertermijnen. Bij overmacht langer dan 30 dagen zijn beide partijen gerechtigd de overeenkomst kosteloos te ontbinden voor het deel dat nog niet is uitgevoerd.

12. Toepasselijk recht en geschillen

Op alle overeenkomsten met GrowthMaster is het Nederlands recht van toepassing. Geschillen worden bij voorkeur in onderling overleg opgelost. Lukt dat niet, dan worden ze voorgelegd aan de bevoegde rechter in het arrondissement waar GrowthMaster gevestigd is.

13. Wijzigingen voorwaarden

GrowthMaster mag deze voorwaarden van tijd tot tijd aanpassen. De versie die gold ten tijde van de overeenkomst blijft echter geldig voor lopende opdrachten. Bij wezenlijke wijzigingen worden bestaande klanten actief op de hoogte gebracht.

1. Definitions

• GrowthMaster: Kelly Kap, freelance webdeveloper, SEO specialist and AI automation expert. Email: kelly@growthmaster.nl. Phone: +31 6 57144073.
• Client: the natural or legal person commissioning GrowthMaster to deliver services.
• Services: webdesign, SEO audits, content strategy, AI automation, or other agreed work.
• Agreement: the written arrangement (email is sufficient) between GrowthMaster and the Client describing scope, price and delivery deadline.

2. Applicability

These terms apply to all quotes, assignments and agreements with GrowthMaster, unless explicitly agreed otherwise in writing. Any purchasing or other terms from the Client are explicitly not applicable.

3. Quotes and offers

• All quotes are non-binding and valid for 14 days, unless stated otherwise.
• Prices exclude VAT and any third-party costs (hosting, domain, third-party APIs), unless explicitly stated otherwise.
• An assignment is established once the Client confirms the offer in writing (by email).

4. Productized offerings

GrowthMaster also delivers fixed packages with clear scope and price:

• Site in 1 week — €749 setup + €395/month, 6-month minimum commitment. Includes Webflow or Astro site, basic SEO, hosting, copywriting and 1 round of feedback. Live within 14 days or money back.
• Daily Scan — €39/month. Daily SEO audit with top-3 issues by email. Cancel monthly.
• Audit Plus — one-off €495. In-depth technical SEO audit with implementation roadmap.
• Sprint — one-off €1,495. One-week sprint for specific growth challenges.
• Flows on autopilot — from €495 setup + €99/month. AI flows for lead handling, email automation or content generation.

5. Payment

• Setup fees are invoiced upfront and payable within 14 days.
• Monthly retainers are invoiced at the start of each month via Stripe / manual invoice.
• If payment is overdue, GrowthMaster may suspend work and charge statutory interest.
• For monthly contracts a notice period of 1 full calendar month applies after the minimum commitment period.

6. Delivery and execution

• GrowthMaster will make best efforts to meet agreed delivery deadlines, but these are indicative unless explicitly guaranteed in writing (e.g. the "live in 14 days or money back" guarantee).
• Scope changes after the assignment may lead to additional work, billed separately by mutual agreement.
• The Client provides required input on time (content, CMS/hosting access, approval on concepts). Delays caused by the Client do not change the agreed price.

7. "Live in 14 days or money back" guarantee

For the Site in 1 week package: if GrowthMaster fails to deliver a live site meeting the agreed scope within 14 calendar days of receiving all required input, the Client receives the full setup amount back. This does not apply when the delay is caused by Client-side input/feedback delays, or by force majeure (see art. 11).

8. Intellectual property

• Until full payment, all rights to delivered work (code, design, content) remain with GrowthMaster.
• After payment, usage rights transfer to the Client, except for any third-party components (e.g. open-source libraries, stock photos, fonts) that retain their own licenses.
• GrowthMaster retains the right to display delivered work in portfolio and case studies, unless explicitly agreed otherwise.

9. Liability

• GrowthMaster's liability is limited to the amount paid out in the relevant case by the liability insurance, or in the absence thereof to a maximum of the invoice amount of the relevant assignment.
• GrowthMaster is not liable for indirect damage, consequential damage, lost profits, missed savings or business interruption damage.
• The Client indemnifies GrowthMaster against third-party claims regarding content/materials supplied by the Client (e.g. copyright infringement on supplied photos or text).

10. Confidentiality

Both parties treat all information exchanged within the collaboration as confidential, insofar as the nature of it reasonably requires this. Personal data is processed according to the privacy statement.

11. Force majeure

In case of force majeure (such as long-term power outage, serious illness, war, pandemics or large-scale internet infrastructure failure) GrowthMaster is not bound by delivery deadlines. If force majeure lasts longer than 30 days, both parties may dissolve the agreement free of charge for the part not yet executed.

12. Applicable law and disputes

Dutch law applies to all agreements with GrowthMaster. Disputes are preferably resolved by mutual consultation. If that fails, they are submitted to the competent court in the district where GrowthMaster is established.

13. Changes to terms

GrowthMaster may amend these terms from time to time. The version that applied at the time of the agreement remains valid for ongoing assignments. For substantive changes, existing clients are actively informed.
